Terms of Service

1. Parties and Agreement

Service Provider: Jibraeel Management Consulting CC ("HeyHalaal", "we", "us"), a South African close corporation.
User: Any person accessing or using heyhalaal.co.za ("the Platform").
By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

2. Description of Service — Directory Only

HeyHalaal is a directory service only. It is not a halal certification body, auditor, inspector or validator. HeyHalaal does not certify, validate, endorse or guarantee the halal status of any business, product or service listed on the Platform.

HeyHalaal aggregates and presents information from recognised halal certification bodies and publicly available sources. The sole responsibility for halal certification lies with the relevant certification body. Any queries regarding the validity of a certification must be directed to the issuing certification body — not to HeyHalaal.

Listing a business on HeyHalaal does not constitute certification, endorsement, or approval of any kind by HeyHalaal or Jibraeel Management Consulting CC.

3. Intellectual Property & Copyright

The concept, name "HeyHalaal", brand identity, design, software, and all original content of this Platform are the exclusive intellectual property of Jibraeel Management Consulting CC. All rights reserved.

• The HeyHalaal concept was originated in April 2021 by Jibraeel Management Consulting CC
• Unauthorised reproduction, imitation, or use of the HeyHalaal name, brand or concept is prohibited
• Third-party business data (names, addresses, certification details) is factual and not subject to copyright
• The compilation, selection and presentation of that data constitutes original creative work owned by Jibraeel Management Consulting CC

4. Halal Certification Standards

HeyHalaal only publishes listings for businesses certified by bodies that are:

• Members of or recognised by the World Halal Council (WHC), or
• Operating under ISO-compliant halal certification standards (e.g. SANAS-accredited bodies)

Community-verified listings are clearly marked as such and are not endorsed as formally certified. Always verify the current certification status directly with the relevant certification body before consuming.

5. Accuracy and Liability (CPA Compliance)

In terms of the Consumer Protection Act 68 of 2008, we disclose the following material limitations:

• Certification data is sourced from third-party websites and may be outdated or inaccurate
• Certification statuses change — always verify directly with the certifying body before consuming
• Business contact details, addresses, and operating hours may be outdated
• GPS/map locations are approximate and may not reflect the exact business premises
• HeyHalaal is not liable for any loss arising from reliance on listing information

⚠ Always verify a business's current halal certification status directly with the relevant certification body before purchasing or consuming their products or services.

6. Editorial Discretion — Right to Include or Refuse

HeyHalaal reserves the absolute right, at its sole discretion and without obligation to provide reasons, to:

• Include or refuse inclusion of any business, institution, entity or organisation in the Platform's directory
• Add, remove or suspend any listing at any time, including listings sourced from third-party certification body databases
• Accept or decline any certification body as a recognised source of data on the Platform
• Refuse, modify or retract any submitted listing, advertisement, review or partnership request

This right applies regardless of whether a business holds valid halal certification. Inclusion in this directory does not constitute an endorsement by HeyHalaal, and exclusion does not imply that a business is non-compliant or uncertified.

7. Electronic Communications and Transactions Act (ECT Act)

In compliance with the ECT Act 25 of 2002:

• HeyHalaal is registered in South Africa and subject to South African jurisdiction
• Full contact information: info@heyhalaal.co.za | Operated by Jibraeel Management Consulting CC
• Automated scraping of our Platform without written permission is prohibited under section 86
• Users are prohibited from using the Platform for unlawful electronic communications

8. Protection of Personal Information (POPIA)

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Our information officer can be contacted at: info@heyhalaal.co.za.

Personal information we process: email addresses, names, review content, and usage data. Full details in our Privacy Policy.

You have the right under POPIA to access, correct, or request deletion of your personal information at any time.

9. Cybercrimes Act Compliance

In terms of the Cybercrimes Act 19 of 2020, users are prohibited from:

• Unauthorised access to any part of the Platform
• Submitting false, fraudulent or misleading business listings
• Interfering with the Platform's functionality or security
• Distributing malicious code or content through the Platform

10. Original Content Protection

All original content on HeyHalaal (excluding third-party business data) is protected under the Copyright Act 98 of 1978. You may not reproduce, redistribute, or use this content commercially without written permission. Business data (names, addresses) is factual and not subject to copyright.

11. User Submissions and Reviews

• Reviews are submitted voluntarily and moderated before publication
• By submitting a review, you grant HeyHalaal a non-exclusive licence to publish it
• You confirm that review content is truthful and based on personal experience
• Defamatory, fraudulent, or harassing content will be removed and may be reported to authorities
• One review per email address per business listing is permitted

12. Business Listing Submissions

By submitting a business listing, you confirm:

• The information provided is accurate to the best of your knowledge
• The business holds valid certification from a WHC-recognised or ISO-compliant body
• You are authorised to submit information about the business

Submitting false information may result in removal and legal action under the ECT Act and Cybercrimes Act.

13. Cookies and Tracking

We use cookies as described in our Privacy Policy. Essential cookies cannot be rejected (required for site functionality). Analytics cookies require your consent. You may manage cookie preferences at any time via the cookie settings banner.

14. Advertising

Sponsored listings are clearly marked "Sponsored" or "Featured". HeyHalaal does not endorse advertiser claims. Advertising content must not be misleading in terms of the Consumer Protection Act and Advertising Regulatory Board (ARB) codes.

15. Limitation of Liability

To the maximum extent permitted by South African law:

• HeyHalaal is provided "as is" without warranty of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid by the user to us in the preceding 12 months
• Nothing in these terms limits rights under the Consumer Protection Act that cannot be contracted out of

16. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of South Africa. Any dispute shall be subject to the exclusive jurisdiction of the South Gauteng High Court, Johannesburg, or the applicable Magistrate's Court.

Disputes may also be referred to the National Consumer Commission (NCC) under the Consumer Protection Act, or the Information Regulator under POPIA.

17. Changes to Terms

We may update these terms. Material changes will be communicated by email (if you have an account) and by posting updated terms with a new effective date. Continued use constitutes acceptance.
